Terms of service

Welcome to SerenovaSpas.com (the “Site”). The Site is operated by VSD Products, LLC under the Serenova Spas brand (“Serenova,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Site and purchases you make directly from us through the Site. Please read them before placing an order.

1. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to provide accurate, current information when creating an account, contacting us, or ordering. You are responsible for keeping your account credentials secure and for activity under your account, except to the extent caused by our actions or omissions.

We currently accept online orders for delivery only within the United States. Product availability and delivery options may vary by location.

2. Products and information

We work to display product descriptions, specifications, dimensions, colors, images, availability, and prices accurately. Screen settings, manufacturing variations, and updates to product specifications may cause minor differences. If a material detail of a product you ordered is unavailable or differs from what was offered, we will contact you before fulfilling the affected item and offer an appropriate choice, including cancellation and a refund for that item.

Product use, placement, site preparation, electrical connections, permits, and maintenance should follow the applicable product instructions and local requirements. The scope of any delivery, setup, or installation service is the scope described for your order or in a separate written agreement. Please contact us before ordering if you need to confirm access, placement, or service requirements.

3. Prices, checkout, and orders

Prices are in U.S. dollars unless stated otherwise. Applicable taxes, delivery charges, and other charges will be shown before you submit an online order. Promotions are subject to their stated conditions and dates. We may correct an obvious pricing or product-listing error; if the correction affects an order you already placed, we will notify you and give you the choice to accept the correction or cancel the affected item for a refund.

We will send an order confirmation after you submit an order. We may contact you to confirm details or cancel an order for a legitimate reason, such as unavailability, a payment issue, suspected fraud, or an error in the listing. If we cancel an order after collecting payment, we will promptly refund the amount collected for the canceled item.

You authorize the payment method you select to be charged for the amount shown at checkout. If you choose a financing option, the financing application, approval, rates, promotional terms, and repayment obligations are governed by the financing provider’s disclosures and agreement presented to you. A financing offer is available only if you qualify under that provider’s terms.

4. Shipping and delivery

Available shipping methods, charges, destinations, and any estimated shipping or delivery times are described on the Site, at checkout, or in your order communications. A delivery service includes only the services expressly described for that order. Please provide an accurate delivery address and promptly respond if we need information to arrange delivery.

We will have a reasonable basis for any advertised shipment time. If we cannot ship within the promised time, or within the time required by law when no time was stated, we will notify you and offer the legally required choice to consent to a delay or cancel the unshipped item for a prompt refund. Delivery dates may depend on carrier scheduling and circumstances after shipment. Contact us promptly about a missing, damaged, or incorrect delivery so we can help resolve it. Reporting an issue promptly does not waive any rights you have under law.

Our Shipping Policy provides additional details where applicable. If a shipping term in these Terms conflicts with a right provided by law, the law controls.

5. Cancellations, returns, and refunds

Our Return and Refund Policy explains the applicable cancellation and return process, eligibility, time periods, and any disclosed return shipping or other charges. Review it before ordering, particularly for spas and other large items. The policy in effect when you place your order applies to that order, subject to applicable law and any more specific terms disclosed to you before purchase.

Nothing in these Terms or the Return and Refund Policy limits a refund or other remedy required by law, including rights arising from an unshipped order, a product that is not as described, or an applicable warranty.

6. Product warranties

Any written product warranty is governed by its own terms. The applicable written warranty, when offered, will be available for review before purchase through the product page or another clearly identified method. Please review it for coverage, exclusions, claim steps, and the identity of the warrantor. These Terms do not reduce any applicable written warranty or rights that cannot be waived under law. Warranty registration instructions, if any, are provided with the product or in the applicable warranty materials.

7. Dealer and business purchases

The Site may provide access to dealer accounts, catalogs, and business purchasing features. A dealer’s signed agreement with VSD Products, LLC, and any written terms expressly applicable to a particular dealer order, govern that dealer’s purchases if they conflict with these general Site Terms. These Terms continue to govern use of the Site to the extent they do not conflict with those dealer terms. Consumer promotions and policies do not automatically apply to dealer orders.

8. Acceptable use and intellectual property

You may use the Site for lawful personal or authorized business purposes. You may not interfere with its operation, attempt unauthorized access, introduce malicious code, use automated means that unreasonably burden it, or use its content to mislead others about an affiliation with Serenova.

The Site’s text, images, logos, designs, and other content are owned by us or used with permission from their respective owners. You may view and use the Site to evaluate or purchase products, but you may not reproduce, distribute, or commercially exploit its content without permission, except as allowed by law. No rights in any trademark are granted by your use of the Site.

9. Third-party services and privacy

The Site may link to services operated by others, including payment, financing, or shipping providers. Their services may be subject to their own terms and privacy practices. We are responsible for our own representations and obligations, but we do not control independent third-party sites.

Our Privacy Policy explains how we collect, use, and disclose personal information and how to exercise applicable privacy choices. The Privacy Policy is separate from these Terms.

Our Site is hosted by Shopify, which collects and processes personal information when you visit and make purchases on the Site to provide and improve services. This includes enhanced services based on your interactions with our Site, other merchants, and Shopify. Information you provide is shared with Shopify and other third parties, including parties located in other countries, for these purposes. Our Privacy Policy explains this processing and your privacy choices. You can also review the Shopify Consumer Privacy Policy and visit the Shopify Privacy Portal to learn about Shopify's processing and exercise applicable rights.

10. Site availability and legal rights

We may maintain, change, or temporarily interrupt the Site. We do not promise uninterrupted access or that every page will be free from errors. To the extent permitted by law, we are not responsible for losses caused solely by a temporary interruption of Site access. This paragraph does not limit obligations relating to an order we have accepted, an applicable product warranty, or any rights or remedies that cannot lawfully be limited.

Nothing in these Terms excludes or limits liability or consumer rights to the extent doing so would be unlawful. If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.

11. Changes and governing law

We may update these Terms by posting a revised version with a new effective date. Changes apply to Site use and orders after the revised version takes effect; they do not retroactively change the terms of an order already accepted. New York law governs these Terms to the extent permitted by law, without depriving consumers in other states of protections that apply to them under their state’s law.

13. SMS marketing

Serenova Spas operates this SMS program. When you expressly opt in, you agree to receive recurring marketing text messages from Serenova Spas, which may be sent using automated technology, about spa products, ownership tips, news, and offers. Message frequency varies. Message and data rates may apply. Consent to SMS marketing is optional and is not a condition of purchase. You do not need a customer account to subscribe.

Use the unsubscribe link in a marketing text to stop marketing messages. For help, contact office@serenovaspas.com or 212-713-7727. The sending number is for delivery; contact us directly for questions about products, orders, or service.

Consumer and dealer marketing audiences are kept separate. Signing up for consumer messages does not enroll you in dealer marketing, and dealer account access, warranty registration, or a warranty claim does not itself provide marketing consent. Consumer offers do not automatically apply to dealer purchases.
